State Senator Faces California DUI Case
State senator faces California dui case. While some people believe their chosen profession or celebrity status can keep them from getting arrested for driving under the influence of alcohol (DUI), there is plenty of evidence to the contrary. In the past, law enforcement has gone easy on certain individuals pulled over and suspected of driving under the influence of alcohol. Recently, though, more and more high-profile individuals are being treated as ordinary citizens when it comes to DUI enforcement. For those in licensed professions or holding public office, a DUI can lead to serious collateral consequences, including the potential to derail one’s career. Even for individuals without those concerns, the consequences of a DUI are significant, and can lead to the inability to obtain a job or the loss of driving privileges. If you are in the Santa Rosa and are facing a DUI case, call Beck Law, P.C. as soon as possible to secure legal representation.
The Los Angeles Times is reporting that State Senator Ben Hueso (D-San Diego) is facing two misdemeanor counts of drunk driving in connection with an August 22 traffic stop. According to the report, California Highway Patrol (CHP) stopped Senator Hueso after he was observed driving the wrong way on a one way street in San Francisco. CHP Officer Julie Powell indicated the Senator drove a state issued Ford Fusion at the time of his arrest.
California DUI Penalties and Legal Defenses
Various penalties can be levied against a person found guilty of driving under the influence of alcohol. The consequences imposed are based on a variety of factors, including the level of intoxication, the number of previous offenses, whether any injuries resulted from the incident, and whether any property damage occurred. The penalties stemming from a California DUI include fines, probation, mandatory drug or alcohol counseling, and even jail time. Fortunately, a skilled Santa Rosa DUI defense attorney can raise several defenses in a DUI case. Common defenses include:
- Challenging the reason for the initial traffic stop;
- Calling into question the accuracy of any chemical testing (blood, breath, or urine) that was performed;
- Impeaching the credibility of witnesses testifying against you;
- Introducing evidence of a medical condition that may mimic the appearance of intoxication.
Even in a fairly straightforward case with strong evidence against you, an attorney can often help you get a better plea arrangement than you could on you own.
